1. Scope of Services
Studio Darn provides boutique staging, interior spatial design, and visual media production (including architectural photography and videography) primarily tailored for real estate and hospitality clients in coastal Southern California. All project scopes, deliverables, timelines, and fees will be outlined in a separate, mutually agreed-upon project proposal or service agreement.
2. Intellectual Property Rights
Site Content: All text, imagery, graphics, logos, branding, and design elements on this Site are the property of Studio Darn and are protected by applicable copyright, trademark, and intellectual property laws.
Deliverables: Upon full payment of applicable fees, clients receive a limited license to use the final media deliverables (such as photographs and video assets) for the marketing and promotion of the specific real estate listing or project identified in the agreement. Studio Darn retains the underlying copyright to all creative works and reserves the right to use media assets for our own portfolio, social media, and marketing purposes.
3. Client Responsibilities
Clients are responsible for ensuring that properties are fully prepped, clean, and accessible at the scheduled time of staging or media production.
Studio Darn specializes in market-ready resets and polishes; clients acknowledge that comprehensive pre-listing preparation must align with agreed-upon project parameters.
4. Payment Terms
Payment schedules, retainer requirements, and due dates will be specified in your individual project invoice or agreement.
Late payments may result in the suspension of media delivery or additional administrative fees.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Studio Darn shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, data, use, or goodwill—arising out of or in connection with your use of the Site or our Services, even if advised of the possibility of such damages. Our total liability for any claim arising from our Services shall not exceed the total fees paid by you for the specific project in question.
6. Disclaimer of Warranties
Our Site and Services are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
